ENERGY  LAW  RELATING  TO  THE  POWER   INDUSTRY and UPSTREAM/DOWNSTREAM  OIL  AND  GAS  INDUSTRIES.

Energy Law; Power Generation and Distribution.

The Firm has wide experience in advising both private sector operators and relevant Government Ministries and agencies, in all aspects of power industry law and in recommending changes in those laws, which have enhanced development of the industry in Nigeria and across the West African Sub-region.
The firm has provided legal services to the International Finance Corporation, with regard to their technical assistance to, and investment in, private sector owned “Build/Operate/Transfer” power generation, transmission and distribution plants and has also worked with the Federal Government and  State Governments on their provision of independent power generation facilities.
Members of the firm have been working closely with consultants appointed by the World Bank to advise on improvements in the legal position, to create a work-able framework for the industry in Nigeria and were part of the team that produced the blueprint for the National Electricity Regulatory Commission and the Electric Power Sector Reform Act.  Particular emphasis was placed on providing a realistic legal and operational environment for private sector operators.
Subsequently we have worked with technical consultants on legal due diligence exercises with regard to the break-up of the Power Holding Company of Nigeria PLC, into its successor generation, transmission and distribution companies. This involved a review of the policy, legal and regulatory framework for the power sector in Nigeria and detailed diagnostic reviews of the successor companies.

The firm strongly supports the tenets of accountability and transparency embodied in the “Nigerian Extractive Industries Transparency Initiative” and has experience in advising its clients on the precise legal and commercial requirements of that legislation.
